General terms and conditions

1. Scope

These general terms and conditions apply to all offers, sales, deliveries and services of Delprete Imports, unless otherwise agreed in writing.

By placing an order, the customer accepts these terms and conditions.

2. Offers and conclusion of contract

All offers are subject to change and non-binding.

A sales contract is formed only upon written order confirmation by Delprete Imports or delivery of the goods.

3. Prices and payment terms

Unless stated otherwise, all prices are in Swiss francs (CHF).

Available payment methods are communicated to the customer before the contract is concluded.

The goods remain the property of Delprete Imports until paid for in full.

4. Delivery

Delivery dates are met where possible but are non-binding unless otherwise agreed in writing.

The customer will be informed if a delivery is delayed.

5. Inspection of goods

The customer must inspect the goods as soon as reasonably possible after receipt.

Obvious defects or transport damage must be reported to Delprete Imports within a reasonable time.

6. Trial products

Products provided for testing remain the property of Delprete Imports unless otherwise agreed in writing.

Trial products must be used carefully and as intended. The customer agrees to treat them with the same care as their own belongings.

Normal signs of wear resulting from proper use during the trial period are not considered damage.

In the event of deliberate damage, improper handling or loss, the customer is liable for the resulting damage. Delprete Imports may charge the cost of repair or the replacement value.

7. Guarantee and warranty

Products sold will be replaced or repaired if a demonstrable material or manufacturing defect occurs during normal use for their intended purpose.

The warranty excludes damage caused by improper use, use for unintended purposes, deliberate damage, lack of care, product modifications or normal wear and tear.

For warranty claims, Delprete Imports decides at its discretion whether to repair or replace the affected product.

8. Liability

To the extent permitted by law, Delprete Imports is liable only for damage caused intentionally or through gross negligence.

Liability for indirect damage, consequential damage or loss of profit is excluded.

9. Data protection

Personal data is processed in accordance with the Delprete Imports privacy policy.

10. Changes to these terms

Delprete Imports may amend these terms and conditions at any time.

The version in force when the contract is concluded applies.

11. Applicable law and jurisdiction

Swiss law applies exclusively.

To the extent permitted by law, the place of jurisdiction is Büren an der Aare, Switzerland.
